Platform refers to the Bidwin.pro website, including all associated pages, features, and functionality.

User means any individual or entity that accesses or uses the Platform, whether registered or not.

Vehicle Listing is a vehicle offered for sale through an Auction Provider and displayed on the Platform.

Auction Provider means a third-party auction company that independently operates vehicle auctions in the United States.

Bid is an offer submitted by a User through the Platform to purchase a vehicle from an Auction Provider.

Deposit Authorisationis a temporary hold of funds on a User's payment method to support bidding activity.

Purchase Process covers all steps from a successful Bid through payment, transfer, and documentation.

Third-Party Provider includes Auction Providers, payment processors, shipping companies, logistics partners, customs brokers, and any other external service used in connection with the Platform.

By accessing or using the Bidwin.pro platform, you confirm that you have read, understood and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use the platform or its services.

These terms apply to all visitors, registered users, and anyone who places bids through the platform. We may update these terms from time to time as described in the Changes to These Terms section below.

Bidwin.pro is a European platform that facilitates access to vehicle auctions in the United States. We are not an auction house. We do not own, sell, or take ownership of the vehicles listed on our platform.

Vehicle data displayed on the platform is sourced from independent Auction Providers who operate their own auctions, set their own terms, and manage their own sales processes. We act as a facilitator connecting Users with these Auction Providers and offering coordination support throughout the Purchase Process.

Nothing on this platform constitutes an offer to sell by Bidwin.pro. All transactions are between the User and the relevant Auction Provider, with Bidwin.pro providing intermediary and coordination services.

To place Bids or use certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete registration information, including your full name, email address, and any additional details we may request.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us promptly if you become aware of any unauthorised use of your account.

We may require identity verification before allowing certain activities on the Platform. This may include requesting identification documents or other evidence of identity. We reserve the right to refuse registration or suspend accounts where verification requirements are not met.

Vehicle Listings displayed on Bidwin.pro are provided by independent Auction Providers. We present the information we receive but do not independently verify each listing.

Vehicle availability, auction status, and listing details may change without prior notice. Auction Providers may update, modify, or withdraw listings at any time.

Descriptions, photographs, condition reports, and vehicle history data are sourced from the respective Auction Provider and are presented in good faith. Users should review all available information before placing a Bid.

Bids placed through the Bidwin.pro Platform are submitted to the relevant Auction Provider. Once accepted by the Auction Provider, a Bid may become binding according to the rules of that auction.

You may set a maximum Bid amount, and our system can place incremental Bids on your behalf up to that limit. You are responsible for ensuring that your Bid amounts are accurate and that any applicable Deposit Authorisation is in place.

We do not guarantee that any Bid will be successful. Auction outcomes depend on factors beyond our control, including competing Bids, Auction Provider policies, and technical systems.

A refundable Deposit Authorisation may be required before you can place Bids on certain auctions. This involves a temporary hold of funds on your payment method through a third-party payment provider.

The amount and terms of any Deposit Authorisation will be communicated to you before it is requested. You will have the opportunity to review these terms before authorising the hold.

Deposit Authorisations may be released where applicable in accordance with the terms communicated at the time of authorisation. The release of any authorisation is subject to the policies of the relevant payment provider.

Winning an auction creates a payment obligation toward the Auction Provider. Payments are processed through the Platform using available methods, which may involve Third-Party Providers.

Any platform fees charged by Bidwin.pro for its services will be communicated before they are incurred. These may include service fees, coordination fees, or administrative charges.

Auction Providers may charge additional fees such as buyer premiums, documentation fees, or other charges. These are set by the Auction Provider and are separate from any fees charged by Bidwin.pro.

Bidwin.pro helps coordinate shipping and logistics for vehicles purchased through the Platform. This includes assistance with ocean freight, European delivery arrangements, and customs documentation support.

Shipping costs, customs duties, VAT, import taxes, and related expenses are not included in the auction purchase price unless explicitly stated. Separate quotes for transport and logistics services are provided as needed.

We coordinate with Third-Party Providers for transport and customs services. Delivery schedules depend on factors including carrier availability, port schedules, weather conditions, and customs processing. We do not guarantee specific delivery timelines.

Vehicle condition should be assessed using the available reports, photographs, and documentation provided by the Auction Provider. We do not conduct independent inspections and cannot confirm or guarantee the condition of any vehicle.

Documentation for purchased vehicles, including titles, bills of sale, and export paperwork, originates from the Auction Provider. We assist with coordinating and forwarding these documents where applicable.

We recommend obtaining independent vehicle history reports and reviewing all available documentation carefully before and after purchase.

The Platform relies on various Third-Party Providers, including Auction Providers, payment processors, shipping companies, logistics partners, and customs brokers. These providers operate independently under their own terms and policies.

The performance, reliability, and availability of services provided by Third-Party Providers are outside Bidwin.pro's direct control. We cannot guarantee their actions, omissions, or the quality of their services.

We recommend reviewing the applicable terms and policies of any Third-Party Provider whose services you engage through the Platform.

As a User, you are responsible for providing accurate registration, identity, and payment information. You must keep this information up to date.

You are responsible for understanding how auction bidding works, the costs involved, and the import requirements of your destination country before placing a Bid.

You must comply with all applicable laws and regulations when using the Platform, including those related to vehicle import, customs declaration, and payment obligations.

You are responsible for fulfilling all payment obligations arising from successful Bids in accordance with the applicable auction terms.

You may not use the Platform for any unlawful purpose or in violation of these terms. Prohibited activities include fraudulent bidding, misrepresentation of identity, interference with Platform operations, and unauthorised access to other Users' accounts.

You may not create fake registrations, circumvent Platform systems or security measures, or use automated tools, bots, or scripts to place Bids or interact with the Platform unless explicitly authorised.

Any violation of these prohibitions may result in immediate suspension of your account and legal action where appropriate.

Bidwin.pro provides its Platform and services with reasonable care and skill. However, we cannot guarantee that information sourced from Third-Party Providers is always accurate, complete, or current.

Vehicle condition is determined by the relevant Auction Provider and should be assessed using the reports and documentation they supply. We do not conduct independent inspections and accept no liability for condition-related matters determined by auction sources.

Shipping and logistics depend on Third-Party Providers whose performance is outside our direct control. We accept no liability for delays, damages, or losses arising from the actions or omissions of these providers.

To the extent permitted by applicable law, our liability is limited to the amount of fees paid by you to Bidwin.pro in connection with the specific transaction giving rise to the claim. Nothing in these terms limits or excludes liability where such limitation is prohibited by applicable law.

The Bidwin.pro Platform, including its design, text, graphics, logos, and software, is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our Platform content without prior written permission.

Vehicle listing data, photographs, and descriptions are the property of the respective Auction Providers and are displayed subject to their terms.

We reserve the right to suspend or terminate your access to the Platform if we believe you have violated these terms or engaged in prohibited activities.

You may stop using the Platform at any time. Termination of your account does not affect any obligations arising from Bids placed, purchases made, or services requested before termination.

We may update these Terms and Conditions from time to time to reflect changes in our services, legal requirements, or business practices. When we make material changes, we will update the "Last updated" date at the top of this page and may provide additional notice through the Platform.

We encourage you to review these terms periodically. Continued use of the Platform after changes take effect constitutes acceptance of the updated terms.
