Purpose

This Claims and Vehicle Damage Policy describes how Bidwin.pro handles reports of transport-related vehicle damage that may arise after a vehicle is purchased through the Platform. It explains the process for submitting evidence, how claims are reviewed, and what factors may affect the outcome.

The purpose of this policy is to provide transparency around the claims process so that Users understand what to expect if damage is discovered during or after transportation.

Scope

This policy applies specifically to damage that may occur during the transport of a vehicle following its purchase through the Platform. It covers claims related to physical damage that was not present at the time of auction and was not disclosed in the auction listing.

Issues relating to vehicle condition that existed before purchase, as determined by the Auction Provider's listing and reports, are outside the scope of this policy. Those matters are governed by the auction conditions and the Auction Provider's own procedures.

This policy does not cover mechanical failures, pre-existing damage disclosed in the auction listing, or normal wear and tear.

Vehicle Condition Before Purchase

Vehicle condition before purchase is determined by the Auction Provider. Listings typically include photographs, condition reports, damage descriptions, and available vehicle history data provided by the auction source.

Users are encouraged to review all available information before placing a Bid. Any damage identified in the auction listing or condition report is considered pre-existing and is not eligible for a transport-related claim.

We do not conduct independent inspections and recommend reviewing auction documentation carefully before bidding.

Damage Identified Before Shipping

If damage is identified before the vehicle is shipped, for example during collection from the auction yard or at the loading terminal, photographic evidence is recorded at that stage. Loading terminal photographs are an important source of evidence for establishing the condition of the vehicle at the point of handover to transport.

When damage is noted before shipping, Bidwin.pro will communicate the findings to the User and discuss available options. Depending on the circumstances, this may involve coordination with the Auction Provider or the transport provider.

Different procedures may apply depending on when the damage is first observed and which party is responsible for the vehicle at that time.

Damage Identified After Delivery

If damage is identified after delivery to the final destination, the User should document the condition as soon as possible. Photographs, delivery notes, and any relevant observations should be collected and submitted to Bidwin.pro for review.

Transport-related damage discovered after delivery may involve the transport provider in the claims process, as they are responsible for the vehicle during transit. Bidwin.pro will coordinate communications where applicable but does not guarantee the outcome of any claim made against a transport provider.

Timely reporting is important, as delays in notifying Bidwin.pro about damage may affect the ability to investigate and process the claim.

Evidence Requirements

To support a transport damage claim, the following types of evidence may be required:

  • Clear photographs of the damage from multiple angles
  • Photographs of the vehicle as a whole showing its overall condition at the time of discovery
  • Delivery notes or inspection reports prepared at the time of handover
  • Loading terminal photographs, where available, which serve as a reference for the vehicle's condition before transit
  • Any correspondence with the transport provider regarding the condition upon delivery

Photographic evidence should be taken promptly when damage is discovered. The quality and timing of evidence are important factors in the review process.

Claim Review Process

When a User reports transport damage, Bidwin.pro will review the available information and evidence. The process generally involves the following steps:

  • Submission of the claim with supporting evidence through the Platform or by contacting the support team
  • Review of the evidence by Bidwin.pro to assess the nature of the damage and when it may have occurred
  • Coordination with relevant Third-Party Providers, such as the transport company or loading terminal, where applicable
  • Communication with the User about the findings and any available options

The outcome of a claim depends on the specific circumstances, the quality of evidence, and the involvement of Third-Party Providers. Not every claim is accepted.

We aim to handle claims in a reasonable timeframe, but the duration may vary depending on the complexity of the case and the responsiveness of involved providers.

Third-Party Providers

Transport-related claims may involve several Third-Party Providers, including transport companies, loading terminals, shipping lines, and customs agents. These providers participate in the logistics chain and may have their own procedures for handling damage claims.

Bidwin.pro coordinates the claim process where applicable but does not control the policies, investigation procedures, or decisions of Third-Party Providers. The outcome of a claim may be influenced by the relevant provider's own terms and assessment.

Users may need to engage directly with certain providers depending on the nature of the claim and the stage of transport at which the damage occurred.

Exclusions

The following types of damage or issues are generally not eligible for a transport damage claim through this policy:

  • Damage that was disclosed in the auction listing or condition report before purchase
  • Pre-existing damage recorded in loading terminal photographs taken before shipping
  • Normal wear and tear consistent with the vehicle's age and usage
  • Mechanical issues that are not related to transport
  • Missing equipment or components that were already noted as absent in the auction description
  • Damage caused after delivery by the User or a third party not involved in the transport chain

Auction rules may also apply and could affect eligibility for certain claims. Users should review the relevant auction conditions alongside this policy.

The following points are important to understand about the claims process:

  • Every claim depends on its specific circumstances. There are no guaranteed outcomes.
  • Not every claim submitted is accepted. Each case is reviewed based on the available evidence and the applicable circumstances.

  • Transport providers may have their own separate claim procedures that apply independently of this policy.
