These terms govern the purchase process when you submit a bid on a vehicle through the Bidwin.pro platform. Please read them carefully before participating in an auction.

Definitions
Platform refers to the Bidwin.pro website, including all associated pages, features, and functionality.
User means any individual or entity that accesses or uses the Platform, whether registered or not.
Auction Provider means a third-party auction company that independently operates vehicle auctions in the United States.
Vehicle is a motor vehicle offered for sale by an Auction Provider and listed on the Platform.
Bid is an offer submitted by a User through the Platform to purchase a Vehicle from an Auction Provider.
Purchase refers to the successful acquisition of a Vehicle following a winning Bid, including all associated payment and transfer steps.
Depositis a temporary authorisation or hold of funds on a User's payment method used to establish bidding eligibility on the Platform.
Third-Party Provider includes Auction Providers, payment processors, shipping companies, logistics partners, customs brokers, and any other external service used in connection with the Platform.
Purpose of These Terms
These Purchase and Auction Terms set out the rules and procedures that apply when a User submits a Bid through the Platform. They complement the general Terms and Conditions and govern the specific transaction process from bidding through to post-purchase coordination.
In the event of any inconsistency between these Purchase and Auction Terms and the general Terms and Conditions, these Purchase and Auction Terms shall prevail with respect to matters relating to bidding, purchase, and transaction execution.
Platform Role
Bidwin.pro is a European platform that facilitates access to US vehicle auctions. We are not an auction house. We do not own the Vehicles listed on our Platform and we do not act as a seller in any transaction.
Our role is to provide Users with tools to browse Vehicle listings, submit Bids to Auction Providers, and coordinate the Purchase process. Where applicable, we act on behalf of the User during the purchasing workflow and coordinate shipping, logistics, and documentation through Third-Party Providers.
All transactions are ultimately between the User and the relevant Auction Provider. Bidwin.pro facilitates and coordinates but does not guarantee auction outcomes, Vehicle condition, or third-party service performance.
User Eligibility
To participate in auctions through the Platform, you must be at least 18 years old and have the legal capacity to enter into binding agreements. You must also comply with the laws of your country of residence regarding participation in vehicle auctions and cross-border purchases.
We reserve the right to verify your eligibility before allowing you to place Bids. This may include checks on your identity, payment method, and bidding history.
Account Requirements
To submit a Bid, you must register for an account on the Platform and provide accurate, current, and complete information. This includes your full name, email address, billing details, and any identification documents we may request.
You are responsible for maintaining the security of your account credentials. Any Bid placed through your account is considered to have been made by you, and you are responsible for fulfilling all obligations arising from that Bid.
We may require identity verification before activating bidding functionality on your account.
Vehicle Listings
Vehicles listed on the Platform are sourced from independent Auction Providers. We display the information we receive, including descriptions, photographs, condition reports, and vehicle history data where available.
Vehicle availability, auction status, and listing details may change at any time without prior notice. Auction Providers may update, modify, or withdraw listings according to their own procedures.
We recommend reviewing all available information and any applicable auction terms before submitting a Bid.
Submitting a Bid
When you submit a Bid through the Platform, your offer is transmitted to the relevant Auction Provider for consideration. You may set a maximum Bid amount, and the Platform may place incremental Bids on your behalf up to that limit in accordance with the auction format.
A Bid becomes binding when accepted by the Auction Provider in accordance with their auction rules. Once binding, you are obligated to complete the Purchase if your Bid is successful.
We do not guarantee that any Bid will be successful. Auction outcomes depend on factors beyond our control, including competing Bids, Auction Provider policies, reserve prices, and technical systems.
Winning an Auction
If your Bid is successful, you will be notified through the Platform. A successful Bid creates a binding purchase obligation between you and the Auction Provider, with Bidwin.pro facilitating the subsequent steps.
You will receive details of the winning amount, applicable auction fees, and any platform service charges that apply. These amounts must be settled to proceed with the Purchase.
We coordinate the payment workflow and documentation process following a successful auction result.
Payments
The total amount due in connection with a Purchase may include the following components where applicable:
- The winning Bid amount payable to the Auction Provider
- Auction fees charged by the Auction Provider, which may include buyer premiums and documentation fees
- Platform fees charged by Bidwin.pro, which will be communicated before they are incurred
- Shipping and logistics costs, quoted separately based on your requirements
- Customs duties, import taxes, and VAT, which are determined by the destination country
Payments are processed through the Platform using available payment methods. Third-Party Providers may handle transaction processing according to their own terms and policies.
All relevant charges will be communicated before payment is requested. We do not set or control fees imposed by Auction Providers or other Third-Party Providers.
Shipping Coordination
Following a successful Purchase, Bidwin.pro helps coordinate the transport of the Vehicle from the Auction Provider to your chosen destination. This includes arranging inland transport from the auction yard to the port of export, ocean freight to Europe, and European delivery arrangements.
We also provide support with customs documentation required for import into the destination country. Transport may involve multiple providers, and scheduling depends on factors including carrier availability, port schedules, and customs processing times.
Shipping costs, customs duties, and import taxes are not included in the auction purchase price. Separate quotes for transport and logistics are provided based on your specific requirements. We do not guarantee specific delivery timelines.
Vehicle Information
Information about Vehicle condition, specifications, and history is provided by the Auction Provider. This may include auction reports, photographs, damage descriptions, and available vehicle history data.
We do not conduct independent inspections of Vehicles listed on the Platform. Vehicle condition should be assessed using the reports and documentation supplied by the Auction Provider.
We recommend obtaining independent vehicle history reports and reviewing all available documentation before submitting a Bid. Documentation for purchased Vehicles, including titles and bills of sale, originates from the Auction Provider.
Third-Party Providers
The Purchase process involves several Third-Party Providers, including Auction Providers, payment processors, transport companies, logistics partners, and customs agents. These providers operate independently under their own terms and conditions.
The performance and reliability of Third-Party Providers are outside Bidwin.pro's direct control. Delays, errors, or failures attributable to these providers may affect the Purchase process, including auction clearance, payment processing, shipping schedules, and documentation timelines.
We recommend reviewing the applicable terms and policies of any Third-Party Provider involved in your transaction.
User Responsibilities
As a User participating in auctions through the Platform, you are responsible for:
- Providing accurate registration and payment information and keeping it up to date
- Understanding the auction rules of the relevant Auction Provider before placing a Bid
- Ensuring you have sufficient funds or Deposit arrangements in place before bidding
- Fulfilling all payment obligations arising from successful Bids
- Complying with all applicable laws, including those related to vehicle import and customs requirements in your destination country
Failure to Complete a Purchase
If a User fails to meet their payment obligations following a successful Bid, the Purchase may not proceed. In such cases, the Auction Provider may take action according to their own terms, which could include cancellation of the sale and forfeiture of any Deposit where applicable.
Repeated failure to complete purchases may result in restrictions on bidding activity or suspension of your account. We may also take steps to recover any costs incurred as a result of the incomplete transaction.
We encourage Users to bid responsibly and to ensure they understand the financial commitment involved before participating in an auction.
Limitation of Responsibility
Bidwin.pro provides its Platform and coordination services with reasonable care and skill. However, we do not accept responsibility for:
- The accuracy, completeness, or timeliness of information provided by Auction Providers
- The condition of Vehicles, which is determined by the relevant Auction Provider
- The outcome of any auction, including the success or failure of Bids
- Delays, damages, or losses arising from the actions or omissions of Third-Party Providers
- Shipping timelines, customs clearance times, or delivery schedules
To the extent permitted by applicable law, our liability is limited accordingly. Nothing in these terms limits or excludes any rights or responsibilities that cannot be limited or excluded by applicable law.
Third-party auction data, vehicle condition, auction outcomes, and logistics remain subject to the relevant providers and the specific circumstances of each transaction.
Changes
We may update these Purchase and Auction Terms from time to time to reflect changes in our services, legal requirements, or business practices. When we make material changes, we will update the "Last updated" date at the top of this page and may provide additional notice through the Platform.
We encourage you to review these terms periodically. Continued participation in auctions through the Platform after changes take effect constitutes acceptance of the updated terms.
